User agreement
for the Information System "Educational Space NIS Ustaz"

This User Agreement (hereinafter referred to as the Agreement) establishes the terms of use for the information system of the Autonomous Educational Organization “Nazarbayev Intellectual Schools,” BIN 080540020707 (hereinafter referred to as the Rights Holder), and is an agreement between the Rights Holder and the individual using the information system "Educational Space NIS Ustaz" (hereinafter referred to as the User).

1. Scope of the Agreement

1.1. In accordance with this Agreement, the Rights Holder grants the User free access to the services and content of the information system "Educational Space NIS Ustaz" (hereinafter referred to as the Platform), and the User agrees to use the services and content of the Platform solely for educational purposes (not for commercial distribution or for generating income).

1.2. Without the prior written consent of the Rights Holder, the User shall not:

  1. reproduce the content;

  2. distribute the original or copies of the work (content) in any form, including by sale, exchange, lease (rental), or other operations, including through open telecommunications networks;

  3. import copies of the work (content) for distribution, including copies lawfully made with the author’s or another copyright holder’s permission;

  4. publicly display the work (content);

  5. publicly perform the work (content);

  6. publicly transmit the work (content), including via broadcast or cable;

  7. broadcast the work (content), including its initial and/or subsequent transmission for general access;

  8. transmit the work (content) by cable, including its initial and/or subsequent transmission for general access;

  9. translate the work (content);

  10. adapt, arrange, or otherwise modify the content;

  11. make the work (content) available in the public domain.

These restrictions do not apply when the User utilizes the Platform’s services and content exclusively for educational and informational purposes in relation to students of Nazarbayev Intellectual schools Autonomous Educational Organization.

1.3. The Rights Holder registers the User using a unified authentication mechanism based on the Rights Holder’s Active Directory (AD).

1.4. Use of the Platform signifies the User’s full acceptance of all the terms of this Agreement.

2. User's Personal Data

2.1. By entering into this Agreement and authorizing on the Platform, the User agrees to the collection and processing of personal data by the Rights Holder (including systematization, accumulation, storage (including in case of claims), clarification (update, modification), use (including for the purposes of individual communication with Users, distribution of Rights Holder’s materials, sending invitations to events, conferences, exhibitions, and other purposes not prohibited by the legislation of the Republic of Kazakhstan), dissemination (including transfer to third parties and cross-border transfer), anonymization, blocking, destruction, and placement/indication of the provided personal data.

3. Rights and Obligations of the User

3.1. The User has the right to use the Platform (content and services) within the limits and in the manner stipulated by this Agreement.

3.2. The User has the right to refuse to use the Platform in case of disagreement with the changes made to this Agreement or with the new version of the Agreement.

3.3. The User has the right to contact the Platform’s support service to obtain the necessary information.

3.4. The User agrees to keep his account credentials confidential, not to disclose them to third parties, and not to share them with other Users.

3.5. The User undertakes not to post on the Platform any information or materials (including links thereto) that may violate the rights and interests of the Rights Holder or third parties.

3.6. The User undertakes to use the Platform only for educational purposes, not to disclose information to third parties, and not to use it for commercial distribution or profit-making purposes.

3.7. The User undertakes not to infringe upon the copyrights of the Rights Holder and/or third parties, including copyrights to the content.

4. Rights and Obligations of the Rights Holder

4.1. The Rights Holder has the right, at its discretion, to determine the content posted on the Platform, to supplement and modify it at any time, as well as to remove it upon request of authorized government bodies or stakeholders if such content violates the legislation of the Republic of Kazakhstan or the rights and legally protected interests of third parties.

4.2. The Rights Holder has the right to place audiovisual and/or other advertisements on the Platform that directly or indirectly relate to the activities of the Rights Holder.

4.3. In case of violation of the terms of this Agreement and/or the requirements of the legislation of the Republic of Kazakhstan, the Right Holder reserves the right to suspend, restrict, or terminate the use of the Platform by the User.

4.4. The Right Holder is entitled to file a lawsuit in court and claim compensation from the User for damages caused by the User’s unlawful actions or inaction that resulted in material loss and/or harm to the business reputation of the Right Holder.

4.5. The Right Holder undertakes to consult or otherwise inform the User on matters related to the use of the Platform via email and/or the support contacts provided on the Platform.

4.6. If the User leaves the organization (removal from AD or relocation outside the access group), access to the Platform is automatically blocked.

5. Responsibility of the Parties

5.1. The User undertakes to compensate the Right Holder for proven damages (material losses) caused by the User’s actions or omissions while using the Platform.

5.2. The Right Holder shall not be liable for any actions or decisions made by the User or third parties based on the information contained in the Platform’s content.

5.3. The Right Holder shall not be liable for unauthorized use of the User's personal data by third parties if it resulted from the User's failure to maintain confidentiality.

5.4. The Rights Holder shall not be liable for any failure or improper performance of its obligations arising from, but not limited to: (a) force majeure events; (b) amendments to or repeal of regulatory legal acts; (c) actions of governmental authorities or third parties; (d) deterioration in the quality of services provided by telecommunications operators; or (e) other causes beyond the control of the Rights Holder.

6. Final provisions

6.1. Any issues not regulated by this Agreement shall be subject to the current legislation of the Republic of Kazakhstan.

6.2. All disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located at the Rights Holder’s place of residence in accordance with the applicable laws of the Republic of Kazakhstan.

6.3. The Rights Holder’s failure to act in the event of a User’s breach of the provisions of this Agreement shall not deprive the Rights Holder of the right to take appropriate measures to protect his interests at a later time.

6.4. This Agreement may be amended in whole or in part by the Rights Holder at any time without any prior notice. The new edition of the Agreement shall enter into force from the moment it is published on the Platform. The User is obliged to monitor the changes made to this agreement independently.
